1. Information About Us
1.1 The website www.ongradio.com is operated by Ong Radio International Pte Ltd, a company registered in Singapore under Business Registration Number 199805908M, with its registered office located at 176 Orchard Road, #03-41 The Centrepoint, Singapore 238843.
2. Service Availability
2.1 This website is intended for use by individuals, businesses, and companies located within Singapore (the “Serviced Country”). We do not accept or fulfil orders from customers outside the Serviced Country.
3. Your Status
3.1 By placing an order through our website or via telephone, you represent and warrant that:
3.1.1 You are legally capable of entering into binding contracts; and
3.1.2 You are a resident of the Serviced Country.
4. Formation of Contract
4.1 Upon submission of an online order, you will receive an acknowledgment email confirming receipt of your order. Please note that this acknowledgment does not constitute acceptance of your order. Your order represents an offer to purchase a product, which is subject to our acceptance. Acceptance will be confirmed either via email or verbally, and the contract (“Contract”) will be deemed formed only upon delivery of the items to you.
4.2 Orders are subject to stock availability. Where an item is unavailable, a suitable replacement may be offered with your verbal or written consent. If no replacement is possible, we will notify you and provide the option to cancel the order. A full refund will be issued if payment has already been made.
4.3 Orders placed online will typically be fulfilled within one (1) business day, unless otherwise stated. Business days exclude Saturdays, Sundays, and public holidays.
4.4 Full payment must be made using the payment method selected during checkout.
4.5 Product batches may vary due to manufacturing limitations. If you are unsatisfied with a product, you may return it within two (2) days of delivery, provided it remains unused, in its original condition, and is not a pre-order item. Please refer to Section 7 – Our Refunds Policy for further details.
5. Our Status
5.1 Our website may contain links to third-party sites or affiliated partners. Ong Radio does not make any warranties or representations regarding the quality, safety, or legality of products or services offered on third-party websites.
6. Price and Payment
6.1 Product prices are stated on our website and are subject to change without prior notice, except in cases of obvious error.
6.2 While we make every effort to ensure accurate pricing, errors may occur. In the event of a pricing discrepancy, we will verify and confirm the correct price prior to dispatch:
- If the correct price is lower, you will be charged the lower amount.
- If the correct price is higher, we may at our discretion honour the lower price, contact you for confirmation before proceeding, or cancel your order and issue a refund.
6.3 We are not obligated to honour any price that is incorrect, even after an order confirmation has been issued.
6.4 Promotional coupons are valid for single use only and are non-transferable, non-stackable, and non-redeemable after expiry.
7. Our Refunds Policy
7.1 If you return a product whether due to cancellation, dissatisfaction, defect, or disagreement with our terms we will inspect the returned item. Subject to verification of its condition, we will either provide a replacement or issue a refund using the original payment method. Refunds will be processed promptly after approval.
7.2 Products returned within the two-day cooling-off period or found to be defective will be refunded in full, less delivery charges.
7.3 Claims regarding short delivery must be submitted within two (2) days of receipt. Failure to notify us within this timeframe shall constitute acceptance of the goods as delivered.
7.4 Customers are responsible for all return shipping costs unless otherwise stated.
8. Our Liability
8.1 We warrant that any product purchased through our website will be of satisfactory quality.
8.2 Our total liability in connection with any purchase shall not exceed the purchase price of the relevant product.
8.3 Unless otherwise stated, all warranties are provided directly by the respective brand owner.
8.4 In the event of a failed delivery within the scheduled time slot, we will make reasonable efforts to preserve the product for up to 24 hours. Orders not collected within this timeframe will not be eligible for refund. Changes to delivery details made after order submission may incur an administrative fee of S$10.00.
8.5 All samples, descriptions, drawings, and specifications on our website or in catalogues are for illustrative purposes only and do not constitute part of any contract.
8.6 If the Buyer fails to accept delivery or if delivery cannot be completed due to incomplete instructions or authorisations, then:
a) risk in the goods shall pass to the Buyer (including loss or damage caused by negligence);
b) the goods shall be deemed to have been delivered; and
c) the Company may store the goods, and the Buyer shall bear all related costs, including storage and insurance.
9. Notices
9.1 All notices will be sent to you via the email or postal address provided at the time of order.
10. Events Beyond Our Control (Force Majeure)
10.1 Ong Radio shall not be held liable for any failure or delay in performance caused by circumstances beyond our reasonable control (“Force Majeure Event”).
10.2 Such events include, but are not limited to:
- Industrial disputes, strikes, or lock-outs
- Civil unrest, war, terrorism, or natural disasters
- Fire, explosion, flood, or other acts of nature
- Transportation or communication network failures
- Acts, decrees, or restrictions imposed by governmental authorities
10.3 In such circumstances, performance of our obligations shall be suspended for the duration of the event, with an extension of time granted accordingly. We will take reasonable steps to mitigate the impact and resume normal operations as soon as possible.
11. Waiver
11.1 Any delay or omission by Ong Radio in exercising its rights under this Contract shall not constitute a waiver of those rights.
11.2 A waiver of one breach shall not be deemed a waiver of any subsequent breach.
11.3 No waiver shall be effective unless expressly stated in writing by Ong Radio.
12. Severability
12.1 If any provision of these Terms and Conditions is determined by a competent authority to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
13. Entire Agreement
13.1 These Terms and Conditions, together with any documents expressly referenced herein, constitute the entire agreement between you and Ong Radio.
13.2 Both parties acknowledge that, in entering into this Contract, neither has relied on any prior representations or promises not expressly set forth herein.
13.3 No party shall have any remedy in respect of any untrue statement made prior to the Contract, except where such statement was made fraudulently.
14. Variation of Terms
14.1 Ong Radio reserves the right to revise or amend these Terms and Conditions at any time.
14.2 The applicable Terms and Conditions are those in effect at the time of your order, unless a change is required by law or notified to you prior to dispatch. Continued use of our services constitutes acceptance of such amendments.
15. Governing Law and Jurisdiction
15.1 These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of Singapore. Any disputes arising from or related to these Terms shall be subject to the non-exclusive jurisdiction of the Singapore Courts.
